
Thinking Sentencing.
Sentencing judges are supposed to consider in a hearing punishment, fairness, deterrence and rehabilitation. Too often punishment, becomes the only factor seriously considered when meting out a jail sentence. However, every sentencing hearing should emphasize to the court the winning factors in a defendant's presentation, which is built upon extensive preparation.
At the sentencing hearing, everything that could be considered by a court is 'fair game'. Background information, such as military service, an extraordinary personal circumstance or steps made prior to sentence to rehabilitate are critical to convincing a judge to be "lenient". For example, if a person stands convicted of a drug offense, waiting until sentencing to obtain a alcohol and drug dependency evaluation or involve oneself in formal treatment or "AA" type meetings, may be too late. Judges are bombarded by statements of what you are "gonna do" and are much more likely to be persuaded by what you "have done".
